Trump's lawyers write that given how many people voted for him, the claims "should be heard on the merits" — but recall this case is not up on appeal about the merits. The campaign is asking for emergency review of the judge denying its request to file a 2nd amended complaint

They contend oral argument would be helpful to address issues raised by PA, the DNC, and other parties in briefs filed yesterday, which they then touch on in a set of footnotes

The first footnote argues there was no undue delay in filing the 2nd amended complaint b/c given the shifting makeup of the campaign's legal team, there was "confusion" that led to the filing of the 1st amended complaint, which removed sections and a number of counts

Four years ago yesterday, I woke up believing this country was ready to elect its first woman president. I challenged anyone who'd listen not just to defeat her opponent, but to defeat the conditions that gave him rise.

I admit: I underestimated the depth of US misogyny.

The current administration wasted no time slathering insults on political injuries. In the past four years, the breathless whispers through clutched pearls of "that's not who we are" can be matched only by the wails in the past 24 hours of "I thought we were better than this."

This is who this country has always been.
It has never been better than this.

If you are Black in the US you are ill-afforded the luxury of racial naiveté. We know this country better than it knows itself, because we've had to.

Being hyper aware of authoritarian tendencies is just part of how we've survived centuries of oppression.

We learned history that was never taught to us, occupied spaces, (including the Oval Office) never designed to accommodate us.

We have consistently fought for the equality that's been denied to us, under law.

We are now 5 days out from the most important election in the history of our country. I want to share a few quotes from previous Q drops that we have been given, in hopes of firing you up even more than you already are.

Trump is trying to overturn the election results. I doubt he’ll be successful. But I don’t know it for sure.

In the coming weeks, I’ll be watching two things:

1. Certifications
2. GOP state legislators and

There are two things that are set to happen with the election results in the coming weeks that ordinarily would be formalities, but in a disputed election are crucial.

First is the states' certifications of their results. Second is the selection of electors.

Right now, both processes are clearly on track to make Biden the next president.

Trump's only hope is to upset the apple cart on one or both. Blocking or delaying certifications somehow, or getting partisan GOP state legislators in states Biden won to appoint Trump electors.

Re: certifications, Trump will get little help from officials in the key states— they're mostly Democrats or bipartisan boards, except for GA Sec of State Brad Raffensperger.

Raffensperger is being pressured from the right, but he's pushed back so far

With dim prospects for getting state officials to block certifications, Trump has been trying to get judges to do that, by filing lawsuits.

These lawsuits seem weak so far. But watch if judges start to take any of them

It's now been nearly two weeks: Has the "fact-checking" process been completed? Have our stories been allowed to recirculate?

Because in the interval, neither Joe nor Hunter Biden has disputed the authenticity of the e-mails or the ownership of the hard drive.

In the interval, the director of national intelligence has ruled out that this story was Russian disinformation.

In the interval, the FBI and Justice Department have also ruled out Russian disinformation.

In the interval, a former business partner of Hunter and Jim Biden's (a Democratic-donating naval officer) has come forward, on the record, to confirm the authenticity of another key e-mail thread we exposed.

Already, this story has far more evidentiary and on-the-record corroboration than, say, the Dossier reporting or that blooper of a report in Buzzfeed (remember, @benyt?) on Trump suborning perjury, which the Mueller team demolished within 12 hours.

Georgia did not always elect a Lt. Gov, but in 1946, the state figured there ought to be a backup.

(Of note, Gov/Lt Gov are still elected independently. Not a ticket race.)

So! 1946, Georgia elects a new Governor— Eugene Talmadge. And also elected the state’s very first Lt. Gov as well; a dude named Melvin Thompson.

Talmadge was a thoroughbred shit, and I’ll hear no arguments otherwise.

He died in December 1946, before he could take office.

In the next @NewYorker, I look at a culture of retribution against whistleblowers under Trump—and a new complaint implicating CIA director Gina Haspel and Donald Trump’s nominee for the top legal job in the intelligence community in a retaliation campaign.

In the complaint, a DOJ lawyer claims the retaliation came after he uncovered a secret CIA surveillance program and a practice of lying to prosecutors to conceal its use in criminal cases. The scheme was corroborated in hundreds of pages of emails, transcripts & other documents.

Experts said the concealment may have broken laws and undermined convictions. The FBI told prosecutors that the CIA information, which resulted in numerous prosecutions, came from FBI investigations, named after the Pirates of the Caribbean films, into a fictional crime group.

As the DOJ lawyer, Mark McConnell, raised his concerns to superiors, he faced what six officials said was a retaliation campaign by CIA leadership. Intelligence officials were furious.

CIA officials repeatedly called for repercussions or consequences for McConnell—Haspel allegedly personally joined those calls, though the agency denies it. McConnell’s lawyer, who also represented the Ukraine whistleblower, called for an investigation into Haspel’s role.
