It's trendy to suggest that Trump's attempt at stealing the election has finished off what was left of our democracy. But after everything we've been through in the past four years, I just don't buy that his endgame has been any more harmful than the rest of what he's done to us.

First of all, Trump DID manage to rig the 2016 election. The media largely swept that inconvenient fact under the rug when the evidence started to emerge shortly after he "won" because they were too excited at the ratings that a Trump presidency would give them.

But the reality is that Trump's successful theft of the 2016 election was obviously more harmful to the sanctity of our democracy than his failed theft of the 2020 election. It's just that the media now wants to get ratings out of his failed 2020 attempt.

Trump has spent four years systematically chewing at the fabric of every aspect of our democracy. We don't even know what our democracy is going to look like after this. His tantrum about losing, and zero-chance attempt at overturning it, is just a footnote at the end.

We've all known for four years now that if Trump lost the 2020 election, he'd try to overturn it by any illegal means possible. If you were paying attention, you also knew that if he got blown out, he would have zero chance of overturning it. This isn't some gasp-worthy surprise.

1. In honor of Trump’s last full day in office, and what may end up being the big story of the day, here’s a quick #thread on the President’s pardon power — and answers to some of the questions about it that may come up today:

2. Article II, § 2 of the Constitution gives the President the power to “grant reprieves and pardons for offenses against the United States, except in cases of impeachment.”

The idea was to provide the executive with a check on (perceived) excesses by the courts.

3. That’s why the pardon power is absolute; it wouldn’t be much of a check on the courts if they had the power to review every pardon. Instead, the remedy for abuses of the power, as Chief Justice — and former President — Taft wrote for #SCOTUS in 1925, is ... impeachment.

4. But which offenses can be pardoned? The widespread consensus is that the President may pardon any federal offense (this includes “local” crimes in federal territories like D.C.) by anyone *else* that has been committed (even if not charged) prior to the granting of the pardon.

5. This *includes* so-called “blanket” pardons, such as the one President Carter issued on his first full day in office for Vietnam-era draft

1/ Another observation the #Literalist fallacy I see about how much Trump (ym'sh) has planned all of the chaos & violence. My overarching point will be that society is structured & that means there's an inherent pattern to effects no matter the 'intelligence' behind the causes

2/ The virus should teach us this. #Literalists claim it was made in a lab because they see a killing-machine that carves its way through society and they must apply individual force & cause to the effectiveness of the biological organism

3/ #Literalists see only the tree, not the forest, so they think every effect stands alone, and thus has individual cause. This is the root fallacy of 'intelligent design'

its what led my ancestors to presume every disease is caused by a demon. Nature becomes personified.

4/ [Note, I'm not a deist, I believe in an active, caring God - the God of the Exodus, not just Genesis - but, ironically, in our hidden-faced age I can only see God's presence in the anomalies of nature (miracles), when it skips a pattern, and not from it's surface efficiency.]
