Tax thread: Employees vs independent contractors.

Employee works for an employer.
Independent contractor is basically an entrepreneur.

 2. This highlights two key points:

An employer has some measure of control over the employee.

An "IC" (short for independent contractor) is "his own boss".

It is the responsibility of the employer to determine that a person is either an employee or an IC.
3. Where does PAYE come into play? PAYE is deducted from remuneration. Remuneration applies to employee earnings, whereas for IC's (on certain conditions), their earnings can be excluded from remuneration and therefore no PAYE.

This difference is the scenario of yesterday.
4. There are two important tools: Statutory tests and common law tests. They can be used to determine employee/IC status.

The statutory test is to see if a person is independent from 1: the person paying them;
2 who the work is done for

AND
5. Whether the person is subject to two main things: Control, OR
Supervision

If the person is not independent from the employer (for both the work and the pay) AND the employer has control or supervision of the person - PAYE will apply.
6. The statutory test simply determines whether or not PAYE must be deducted. It does not determine employee status though.

Please read IN 17 carefully and get written advice if anything is unclear.
7. Common law tests - this determines a person's definition as an employee status:

1. Controls manner of working
2. Payment regardless of output
3. Work is done personally
4. Obliged to "pitch up for work"
5. Exclusive relationship with one employer
6. Employer bears the risk
8. Common law tests continued, for employee status:

8. Reports required
9. Training provided
10. Set work hours per contract

There are 10 more, but you get the gist of what I'm saying.

If many of these apply to you, you're a common law employee.
9. To @iamkoshiek's point of yesterday - read your contract carefully to ensure that you are considered an employee or considered an IC. External contractors don't get the same benefits as employees do. Various labour law acts won't apply to you as well.
10. If you are an independent contractor, you're responsible for your own tax (even if PAYE might be deducted). You can also deduct business related expenses (where as employees can't).
11. Technical point on IRP5's. Employee earnings code is 3601; contractors earning code is 3616. This is very important.

If you're an IC and if you receive an IRP5, your IRP5 code must show 3616 for you to deduct expenses against the income.
12. Final tweet: Please read this carefully. What I tweeted here is my paraphrasing and shortenings. Get professional advice which you pay for if anything is unclear.

1. A thread on Downtown #Vancouver's office construction boom. When it's all said and done there will be roughly 10 million SQ FT of space will be added to just the core.

Here's a brief rundown on what is already approved and under construction...

2. We'll start with what is dubbed as Amazon's unofficial HQ2, or at the very least it's Canadian HQ. At 1.1 million SQ FT this is the largest office development in the city and will help shift DT east as it will house 7500 jobs once occupied.


3. The Amazon building is also significant because it will animate that stretch of West Georgia, Homer, Hamilton and Dunsmuir. It will no longer be a black hole for pedestrian activity. There will be approx. 185,000 square feet of retail and food hall space.

4. Next up is the Stack Tower to be anchored by EY. It's at the western edge of the Central Business District (CBD) and will become #Vancouver's tallest office building when complete. It clocks in at roughly 540,000 SQ FT and 530 feet in height.

The question of how TV news amplifies disinformation is often discussed but we have little concrete research on this subject. So we partnered w/ @r_macdonald & @kalevleetaru to understand how cable TV amplified Trump’s tweets. The results are interesting.

Between Jan 1 2020 and Jan 8 2021, CNN, Fox News and MSNBC spent 32 hours showing Trump’s tweets on screen, eg. blowing them up full size. This doesn’t include when anchors and correspondents mentioned things Trump had tweeted.


We then focused on the ways in which the three networks broadcast Trump’s tweets that falsely claimed the election would be fraudulent (before Nov 3) and was actually stolen (after the election).

In the weeks after the election, the cable news networks broadcast nearly three times as many Trump tweets about election fraud than they had in the nine months leading up to it. They even broadcast Trump’s old tweets after he was removed from Twitter in January.

4 points: 1) there was a drumbeat of tweets undermining the election throughout the summer. Many were broadcast & there were no labels from Twitter until middle of Sept. We need more research to understand how a foundation supporting the false narrative was laid by platforms & TV

1. I was walking in the woods yesterday and I had an epiphany. It wasn’t one I wanted to have. I was thinking about today’s class, where we are reading Kimmerer’s ‘Gathering Moss’. I’ve taught Braiding Sweetgrass in multiple classes every year since 2016. It’s eminently teachable

2. Both books are beautifully written. Students uniformly enjoy them as assigned reading. They do a great job communicating to non-Indigenous folks the contours of basic Indigenous relationships to more-than-human beings. They’re wildly popular with white readers.

3. I’ve found Braiding Sweetgrass to be a great entry point for non-Indigenous folks to Indigenous scholarship. But this is where yesterday’s epiphany comes in. Neither Braiding Sweetgrass or Gathering Moss tends to the deep deep lineages of Indigenous scholarship in Canada or US

4. As the popularity of ‘Braiding Sweetgrass’ has soared, I’ve seen more and more white folks wax on about ‘braiding knowledge’. But they often don’t know any of the lineages of these concepts beyond what is presented in this one book. They confidently run with this.

5. Kimmerer does a commendable job of weaving in her own experiences, her family stories+nods to some very important knowledge keepers who deserve to be celebrated for their work. But Braiding Sweetgrass does not tend to the citational politics Sara Ahmed & others teach us about
