Good morning, all. There's a little bit of news out of Michigan already this morning - it looks like Judge Parker wanted to start the work week this week with unnecessary and stupid distractions cleared away.

So she dismissed the MI Kraken tentacle sometime after midnight.

It a 36-page opinion.

And it starts out strong.

Sorry. I'm tweeting without caffeine and it shows. The order rejects the injunction, but it doesn't dismiss the case (yet). Skimming ahead, that appears a foregone conclusion, but technically the case isn't dismissed.

Seriously, though - this is yet another judge who is responding to these request to overturn the election with the judicial version of "you want me to *what*? Hard pass."

The judge is being kind to the plaintiffs here and doesn't mention the epiceyeburningdisasterthatwastheoriginalcomplaint. But you'll note that the judge also doesn't mention what claims were in that complaint or whether they are the same as the ones in the 1st Amended Complaint.

Court states that the officers of ED are willing to come to Mumbai to carry out interrogation and they can proceed with the interrogation subject to the outcome of the plea.

Sr Adv Amit Desai asks the court to note certain facts from the plea.

Desai submits that ED has claimed they do not have certain documents with them. We have submitted those records, these are public records, but we will provide them with whatever additional documents they want.

Desai: So I am submitting that those documents can be sent to the ED, they can go through the documents and then take further course of action.

The High Court gave us 'permission' to bring some of our judicial review arguments in relation to the Government's odd PPE contracts. We are today asking again for permission to bring the others. You can read our (remarkable) Skeleton and Statement here.

We chose these three contracts (Clandeboye/Ayanda/Pestfix) in June/July when we had much less understanding than we do now about what was going on. Once you appreciate that fact, what we have already uncovered (before disclosure) about those three is all the more remarkable.

Let me just focus on one aspect of those contracts: the quality of the product supplied by those companies (respectively, a confectionery wholesaler, a 'family office', and a pest control specialist).

And, rather than me editorialising, let me quote the words of those companies themselves, or Government, or Government agencies.

This is what Government says about what we bought from Clandeboye (we spent a total of £108m on gowns).

But how can they not be cleared for use as gowns? And yet be "authorised for distribution... as part of the PPE ensemble"? It doesn't sound like what we got was gowns.

Kerala High Court resumes hearing of Bail Application of M Sivasankar, Former Principal Secretary of Kerala Chief Minister

Sivasankar is presently in ED's custody for alleged involvement in the Kerala Gold Smuggling case. He is also being investigated by the NIA and Customs Department.

Senior Advocate Jaideep Gupta is arguing for Sivasankar.

He denies ED's allegations that Sivasankar contacted customs officials to clear the baggage alleged to be containing smuggled gold.

Gupta claims statement made by co-accused Swapna Suresh about Sivasankar's involvement are not credible as the same were made after her arrest.

Gupta points out that the correspondence between Sivasankar and Swapna does not disclose any knowledge on the latter's part.

He also tells Court that all of Swapna's statements categorically denied his client's involvement in gold smuggling, until before her arrest.

Supreme Court hears the writ petition filed by CPI Rajya Sabha MP Binoy Viswam @BinoyViswam1 seeking data protection measures for Unified Payments Interface (UPI).

Krishnan Venugopal : Another issue is data localization. Problem with whatsapp, amazon & google is that when they allow payment to happen, data goes abroad. RBI justifies this process by saying that it is fine for data of Indians to go abroad without any formal protection.

Krishnan Venugopal : Critical financial data is allowed to be accessed by companies abroad and RBI justifies it. This is violation of Privacy judgment as my data is being grossly misused as these companies then collect this data and use it for advertisement purposes.

Let’s talk about this story. It discusses a NJ bill that is designed to make sentencing less harsh. The bill is being held up because a lawmaker introduced an amendment that would eliminate the mandatory minimum for one type of corruption.

First, let's talk about the framing of the story. The lede is about how the lawmaker who introduced the amendment has a girlfriend whose son is facing corruption charges. The story minces no words: It says the amendment was added specifically to help that man.

The idea of powerful people helping each other escape punishment is a powerful one. It is the stuff of headlines and outrage, and so I'm not surprised that this is how the story is being framed.

But there is also another way to frame this story--that most people only appreciate the harshness and injustice of the criminal justice system once they or someone they love have been swept up in it.
We've seen the story before, and it sends us a different message.

The "powerful people get off" framing tells us to be suspicious of leniency & not to trust criminal justice reform.

The "I only realized when" framing tells us that we aren't paying enough attention to harshness & more reform is probably needed.

The end around case has been put together by TX AG Ken Paxton suing GA, MI, WI, and PA at SCOTUS. Bringing this case across multiple jurisdictions gives it a straight lane to the SCOTUS.

You may feel that your children’s schools ARE safe. And that may be true. Because White students, while only 10% of the student body, more likely attend selective enrollment and/or more fully resourced schools in CPS.

But the overwhelming majority of children in CPS do not attend well-resourced schools. They attend schls that lack proper ventilation, hot water, nurses or the classroom space needed for social distancing.

The children who attend these under-resourced schools are overwhelmingly Black and Brown. They come from communities where COVID positivity is dangerously high. And they are the children who are dying disproportionately from this virus.
